Do I need a fence permit in Cape Coral? Height, waterfront and front-yard rules, who can pull it, fee

Yes: Cape Coral requires a permit for a new residential fence, and caps it at 6 feet, with open mesh above 3 feet near the water. The City issued 4,177 fence permits on homes from January 2025 to September 2026, the usual one filed at $4,235, and it closed just 21 days after issue.

Where a fence can go

The City's Residential Fence Regulations summarise Land Development Code Article 5, Section 5.2.7 (read 23 October 2026):

Rule Cape Coral single-family and duplex
Maximum height 6 feet; 8 feet if the property abuts a commercial property
Front yard "No part of a fence shall be located in front of the forward most part of the primary structure"
Waterfront lots Within the rear 20 feet abutting a waterway, "must be open mesh above 3 feet in height"
Double-frontage lots (not corners) Front-yard rules on all adjacent streets
Vacant lots "A property must be improved to be permitted for a fence"
Public easements Wood, aluminum, chain-link without slats, or plastic/vinyl only; drainage facilities may restrict more

Allowed materials on the rest of a single-family lot include treated wood, stuccoed block, concrete, stone or brick, wrought iron, aluminum, painted galvanized steel panels, chain-link without slats, and vinyl. On a canal lot that means a solid 6-foot privacy fence cannot run all the way to the seawall.

Who can pull it

Florida licenses no "fence erection" contractor, so the City set out who may apply in a Notice to Industry updated 13 December 2025:

  • Certified General Contractor (CGC) or Certified Building Contractor (CBC)
  • Certified Residential Contractor (CRC), "limited to residential fences only"
  • Certified Specialty Structure Contractor (Florida Rule 61G4-15.015), whose scope includes "aluminum and vinyl fences"
  • Owner/builder, with a notarized owner-builder affidavit, ID verified in person at City Hall, and the property not offered for sale or lease for at least a year. Condo unit owners and corporations cannot use it.

The notice is blunt: "unlicensed individuals or contractors who are not appropriately licensed are not authorized to obtain fence permits". The residential fence guideline (revised January 2026) lists CGC, CBC, CRC and owner-builder; confirm with the City before relying on a specialty license for wood or concrete. A fence installer who asks you to pull the permit yourself is a red flag (Cape Coral contractor license lookup).

How to apply

From the City's residential fence guideline:

  1. In EnerGov Citizen Self-Service, choose "New Fence - Residential", then "New fence not for pool". A fence that is a pool barrier is a different permit.
  2. Upload a site plan and the notarized Burrowing Owl Gopher Tortoise Affidavit. Conditional: Notice of Commencement, Eagle Management Affidavit, 75% open-mesh calculations, manufacturer specs. Forms are on the Permit Document Center.
  3. Environmental review if applicable; then one Fence inspection. A private provider cannot be used for this permit type.

What it costs

From the Miscellaneous Permit Fee Schedule, effective 1 January 2026:

Fee Amount
Fences – Residential $107.00 (2.5% surcharge "may or may not be applied")
Fences – Concrete Fence $328.00 + 2.5% surcharge
Concrete wall / entry wall $192.00
Re-inspection, first / second $48.00 / $67.00

Before you hire

Look the firm up on the Cape Coral fence list and ask which license will be on the permit. National prices are in fence installation cost; other cities' rules in do I need a permit for a fence; past permits on your address in Cape Coral building permit search.

What this does not tell you

The City's open permit file starts in January 2025, so the closed share rests on 2025 permits. HOA and deed rules can be stricter than the City's and are not in any permit record. The filed value is the installer's figure.

How we know this

Placement rules are quoted from the City of Cape Coral Residential Fence Regulations (LDC Art. 5, Sec. 5.2.7), applicant rules from the City's Notice to Industry updated 13 December 2025, and application steps from the New Fence residential guideline revised January 2026, all read 23 October 2026; fees from the Miscellaneous Permit Fee Schedule effective 1 January 2026. Permit counts are City of Cape Coral building permits on residential parcels classified as fence, January 2025 to September 2026; closed share uses permits a year or more old, and days to close is the median from issue to close date.

Numbers come from City of Cape Coral building permits (the city's open permit table starts January 2025), data through October 19, 2026. Nobody paid to be on this page and nobody can.

Questions

  • Do I need a permit for a fence in Cape Coral?

Yes. The City has a New Fence – Residential permit in its EnerGov self-service portal, with a site plan and a notarized burrowing owl and gopher tortoise affidavit always required, and one fence inspection.

  • How tall can a fence be in Cape Coral?

Six feet, or 8 feet where a home abuts a commercial property. On a waterfront lot, any fence within the rear 20 feet along the water must be open mesh above 3 feet, and no fence can sit in front of the forward-most part of the house.

  • How much is a fence permit in Cape Coral?

The City's 2026 miscellaneous fee schedule lists Fences – Residential at $107.00, with the state's 2.5% surcharge possibly added, and a concrete fence at $328.00 plus surcharge.

  • Can a fence company without a license pull a permit in Cape Coral?

No. Florida has no fence-contractor license, so the City's December 2025 notice limits fence permits to certified general, building and residential contractors, certified specialty structure contractors (whose scope covers aluminum and vinyl fences), and owner-builders. Unlicensed installers cannot obtain one.

  • How long does a fence permit take in Cape Coral?

The usual Cape Coral fence permit in our file closed 21 days after it was issued, and 98.3% of permits a year or more old were closed.
